Terms of Service
The agreement between Atelier Booking LLC and everyone who uses the Atelier platform — the businesses that run on it and the customers who book through it. Last updated July 28, 2026.
Who we are
The Atelier platform — including bookwithatelier.com, the Atelier directory, Atelier Studio, and the booking, payments, website, and messaging services provided to the businesses that subscribe to them (the "Platform") — is operated by Atelier Booking LLC, a California limited liability company ("Atelier," "we," "us"). By using the Platform you agree to these Terms. If you are using the Platform on behalf of a business, you agree on that business's behalf and represent that you are authorized to do so.
Booking through Atelier
When you book an appointment, buy a gift card, or purchase services through a business listed in the Atelier directory or hosted on the Platform, your transaction is with that business — not with Atelier. Each business sets its own prices, availability, cancellation and refund policies, and is solely responsible for providing its services. Atelier provides the technology that powers the booking; we are not a party to the appointment. Questions or disputes about a service, charge, or refund should be directed to the business first. Payments you make are processed by the business through its payment processor.
Business subscriptions
Businesses subscribe to the Platform on the plan and pricing shown at the time of signup. Fees bill monthly in advance and renew automatically until you cancel; you may cancel at any time, effective at the end of the current billing cycle, and no partial-month refunds are given. Prices for optional add-ons and additional locations are as published on our pricing page. We may change plan pricing with at least 30 days' notice by email; continued use after the change takes effect constitutes acceptance. Card-processing rates published on our pricing page are all-in rates based on our payment processors' current published pricing (including Stripe); if a processor or card network changes its underlying fees, the corresponding all-in rate may change to pass that difference through, with at least 30 days' notice. Promotional offers (such as a free first month on paid plans) apply as described at signup and may be modified or withdrawn for future signups at any time. You are responsible for any applicable taxes and for keeping your account and billing information accurate.
Your content and your customers
Businesses retain ownership of the content they upload and of their customer relationships and customer data. Atelier is not a marketplace: your customers are yours. You grant us the license needed to host, display, transmit, and back up your content in order to operate the Platform, and nothing more. Upon request at or after cancellation, we will make your customer and booking data available for export in a commonly used format for at least 30 days after your subscription ends.
Acceptable use
You agree to use the Platform only for lawful purposes and not to: send unsolicited or non-consented marketing (email or SMS); upload content that is unlawful, infringing, or deceptive; attempt to probe, disrupt, or circumvent the Platform's security or usage limits; scrape or bulk-extract data from the directory; misrepresent your identity or business; or resell the Platform without our written agreement. We may suspend or remove content or accounts that violate this section.
Messaging compliance
Businesses that use the Platform's email or SMS features are responsible for having the required consent from their recipients, for honoring opt-outs (including STOP requests, which the Platform processes automatically), and for complying with applicable messaging laws and carrier requirements, including the TCPA and CAN-SPAM. Message and data rates may apply to recipients; message frequency varies by business.
Payments
Card and payment processing on the Platform is provided by third-party payment processors (including Stripe), subject to their terms. Atelier is not a bank, money transmitter, or payment processor and does not hold funds. Businesses connect their own processing accounts, and payouts, chargebacks, and processing disputes are governed by the processor's agreement with the business.
AI-assisted features
Some Platform features use artificial intelligence to draft messages, answer customer questions, or assist with scheduling. AI output can be imperfect; businesses are responsible for reviewing AI-assisted communications made on their behalf and remain responsible for their bookings and customer commitments however made.
Availability and changes
We work to keep the Platform available and performant, but it is provided without a guarantee of uninterrupted service. We may add, change, or retire features, and will use reasonable efforts to give notice of changes that materially reduce core functionality of your plan.
Disclaimers
The Platform is provided "as is" and "as available." To the fullest extent permitted by law, Atelier disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will meet your requirements or be error-free, and we make no promises about the conduct, quality, or legality of any business listed in the directory.
Limitation of liability
To the fullest extent permitted by law, Atelier's total liability arising out of or relating to the Platform is limited to the amounts you paid us in the twelve months before the event giving rise to the claim (or one hundred dollars, if you have paid nothing), and in no event will Atelier be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
Indemnification
Businesses will defend and hold Atelier harmless from claims arising out of their content, their services to their customers, or their violation of these Terms or of applicable law — including messaging-consent and consumer-protection claims arising from communications they send through the Platform.
Termination
You may stop using the Platform, or cancel a subscription, at any time. We may suspend or terminate access for material breach of these Terms, for non-payment, or where required by law; where practical we will notify you and give you an opportunity to cure. Sections of these Terms that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) survive.
Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. The state and federal courts located in Orange County, California have exclusive jurisdiction over any dispute arising out of these Terms or the Platform, and each party consents to venue there.
Changes to these Terms
We may update these Terms from time to time. We will post the updated version here with a new "last updated" date, and for material changes affecting subscribed businesses we will give notice by email at least 14 days before they take effect. Continued use of the Platform after changes take effect constitutes acceptance.
